Abstract:
The essence of criminal proceedings focuses on the process of proof. One of the regulated means of evidence is the explanations of the accused. However, insofar as the accused is also a subject of the trial, the question arises as to the nature and significance of the confession made in the course of the proceedings under Art. 371, item 2 of the CCP. And its analysis shows specifics in terms of its application and the time of filing, in terms of its volume and content, as well as in terms of procedural and material consequences of it.
