Abstract:

The decision of the Court of Justice of the European Union on Case C-282/20 was met with unequivocal disapproval as it was considered useless. It is assumed that there is already a legal remedy for removing defects after the first hearing. Nevertheless, this decision could be useful in order to add legitimacy to this legal approach.
