The Resumption as an Extraordinery Procedure for Revision of Rnforceable Administrative Acts

Abstract:

The aim of this report is to present the resumption of the revision of effective administrative acts as an extraordinary procedure and it focuses on differences between the regular procedures such as contestation and reviewing and withdrawing to Superior Administrative Authority. The resumption of proceedings of issuance of administrative acts is comprehensively studied as an exceptional and strictly formal procedure, related to precisely defined deadlines, special grounds or prerequisites for its implementation, legal and technical means for its initiation, limited range of decision-making authorities. The study reveals the ultimate purpose of the resumption of proceedings of issuance of administrative acts which is not to annul or amend the issued act but to create a new one that is free from defects.
