Abstract:
This article deals with the inadmissibility of a warning under Article 28 of the Law on
Administrative Offences and Sanctions for a minor administrative violation under the Road Traffic Act. The
article is based on the written legal opinion prepared by the author on the subject of Constitutional Case No.
29/2024 in connection with an invitation issued by the Constitutional Court. It is concluded that the provision
of Article 189 of the Road Traffic Act is unconstitutional in the part concerning the non-application of Article
28 of the Law on Administrative Offences and Sanctions.
