Is it Possible to Regulate Automated Data Profiling by the Right to Property?

Abstract:

Automated data profiling is a relatively new concept for the information society. It consists of automated processing of data for analysis or prediction of certain personal aspects of the natural persons as a basis for further decision-making. With the adoption of the General Data Protection Regulation profiling was regulated at EU level. The present article analyzes the possibility to regulate profiling by the right to property – the logic behind the proprietary theories, their advantages and disadvantages.
