Резюме:


In recent years trade unions, employers and the State have asserted themselves as active participants in new industrial relations. By common effort, by constructive dialogue, bound by the conclusion of a collective agreement, new solutions are reached, better results are achieved. Collective bargaining is a fundamental partnership mechanism for settling of labor relations with the direct involvement of stakeholders – both employees and employers. In the countries with a market economy and parliamentary democracy the right to collective bargaining is a basic human right settled by negotiations through the implementation ot which each party shall hold and defend its interests. A collective agreement is a complex document for negotiating the conditions to hire, use and release the workforce. In recent decades, a collective agreement has emerged from its traditional frameworks and enters into new territories – negotiation of technological change and related problems of employment and necessary levels of qualification, negotiating of workers’ participation in management, profit and property, negotiating issues of equal treatment in the exercise of the right to employment, reconciliation of work and private life, regulation of relations between the social partners and other issues. Today, in a rapidly changing world, a collective agreement has a chance to become an integral part of the business’s risk management toolkit in a situation of increasing global uncertainty. It is in situations of economic and social insecurity, in crises and fundamental changes, that collective bargaining shall demonstrate its capacity.
