Abstract:

The article Integrated Approach toward a Child-Victim of a Crime is aiming to provide contemporary view of the concept of an observation of the child‘s rights during its participation in criminal procedure. In the subtitle Individual evaluation as a guarantee for higher interest of the child, it is accented upon the obligation of the state from the beginning of its identification as a victim of a crime, to make individual evaluation of its needs. It is reminded about the obligation of the state to apply higher standard of protection of these rights, whenever the national law of criminal procedure provides lesser standard. Exclusively goal-oriented, the article justifies the introduction of an integrated approach in current practice of criminal procedure through individual evaluation of a child from multi-functional team of experts. The article provides a direction to supra-national standard which has to be applied in every criminal procedure, whenever a child happened to be a victim of a crime.
