Abstract:

The summary court investigation is a differentiating institute, enshrined in Chapter XXVII of the CCP, Art. 370-374 CCP. It provides for two completely independent procedures – under Art. 371, item 1 of the CCP and under Art. 371, item 2 of the CCP. Although the proceedings under Art. 371, item 1 of the CCP was regulated as early as 2005, the questions about the stability of the definition under Art. 373, para. 2 of the CCP and the moment of its enactment, as well as for the moment at which the reading of the approved evidence and for the stability of the actions performed in the proceedings should be performed.
