Abstract:
In this article, an attempt has been made to assess the idea of the legislator to incorporate a special anti-state purpose in most of the criminal offences contained in Chapter One of the Bulgarian Penal Code. An analysis is provided of the additional subjective element purpose for the crimes under Chapter One of the Penal Code in view of its significance as a constitutive and distinctive element when provided for in certain criminal offences, and respectively of its role as a mitigating or aggravating circumstance when it is not intended as a constituent element of an offence.
