Abstract:

The Bulgarian Criminal Code provides for absolute statute of limitations after the provisions on the length, interruption and suspension of ordinary limitation periods. At the same time, there is an overall restriction to all absolute periods: they cannot exceed half the corresponding ordinary ones. The Criminal Code, however, contains no other rules for comprehensive regulation of the absolute limitation periods. New rules are necessary to enhance legal certainty in criminal prosecutions and enforcement of punishments. This research paper outlines the existing gaps and the rules that might fill them out.
