Legal Regulation on the Immunity of Magistrates in the Republic of Bulgaria

Abstract:

The immunity of magistrates is one of the most important institutes in any legal and democratic state. It guarantees the effective functioning of the judiciary and, in particular, its bodies, without which it is unthinkable to achieve the basic constitutional values of the modern state, such as democracy, the rule of law and the protection of basic human rights and freedoms. Given the essential importance of the immunity of magistrates, the Bulgarian legislator has regulated its content, as well as the principles related to it, at the constitutional level and in a special normative act – the Law on Judicial Power. This report presents a systematic review of the historical development of the mentioned institute, its legal regulation in modern Bulgarian legislation, its goals, characteristics and elements.
