Abstract:

This article carries out a study of the ex proprio motu principle in administrative proceedings on the suspension of execution and prohibition of access to a whole construction or part thereof by means of an analysis of the regulatory framework, legal theory and judicial practice in the fields of illegal construction prevention and coercive administrative measure application. The grounds and procedure for application, execution and contestation of this type of coercive administrative measures have been examined.
