Abstract:

This article examines the principle of proportionality as one of the fundamental legal principles that is particularly important in administrative law. It traces how this principle came into being and briefly describes the development in its application. The paper also specifies that two concepts are used in the Bulgarian Administrative Procedure Code – proportionality and reasonableness, and that it is difficult and rare to find a difference in scholarly literature and in case law. Furthermore, it considers the achievements of the theory and practice of European courts in applying the principle so far, its elements and manifestations.
