Abstract:

The article aims to emphasize the importance of the two key definitions in international investment disputes. The definitions are fundamental for legitimizing the subjects and clarifying the nature of disputes in international investment law. Their role will be examined through a historical review and an analysis of the different approaches to defining the concepts in international law doctrine. The focus is on the study of the definitions in different international sources and their interpretation and role. Attention will also be paid to the importance of the concepts in view of the subsequent protection of the parties in investment dispute procedures and reviews of the awards will be shared.
