Abstract:
The “non bis in idem” principle is a fundamental legal principle. In practice it may sometimes be breached, especially in those cases when the same act could be seen not only as an offense, but also as an administrative violation. The crucial point to determine whether this principle is observed or breached is the answer to the questions: what constitutes one and the same act. The present article dwells on this very part of the principle “non bis in idem”, namely, the “in idem” element.
