Abstract:

The article deals with the comparison and differentiation between murder in case of exceeding the limits of inevitable defense and murder committed under stress of emotion, induced by violence. The comparison outlines the similarities and differences between the two institutes and examines the jurisprudence. It also examines the basic features of inevitable defense and the criteria of presence of physiological affect when a murder is committed.
