Protection Against Public Receivables Enforcement

Abstract:

The enforcement is the second major method of paying off public receivables. The legal consequences of enforcement are the same as the ones of the voluntary implementation of public receivables, with the particularity that they utilize the resources of state coercion to satisfy the right of the state to obtain the receivables. The executive process can be defined as a statutory compulsion against the debtor. In its turn the protection against enforcement can be viewed as statutory right oftheparties to oppose the unlawful actions of the entities thatparticipate in the executive proceedings. This report aims to describe the terms, conditions and remedies against the unlawful enforcement of public receivables.
