Abstract:
This study is dedicated to the obligations of defence counsel in the criminal procedure and some consequences of their implementation. The possibilities of refusalto the defendant by a defender and a refusal of defender of accepted defenseare discussed. The problem of liability to defence counsel in relation of the statements made in connection with implementing the defense is studied too. Jurisprudence and practice of the Supreme Court of Cassation of the Republic of Bulgaria and of the European Court of Human Rights are also analized. Proposals were made on addendum to legislation.
