Humiliating”: Concept and Essence

Abstract:
The article gives a general description of the evaluative objective
features of the offence; traces the views of the Bulgarian theoretical
thought on the concept of “humiliating” for the period from the beginning
of the XX century to the present day; complements them with the case law
for the same period; distinguishes between “humiliating form”; and “humiliating
content”; analyzes the different ways of realizing the humiliating
content; considers the latter as a set of components manifested through an
objective and subjective feature. Particular attention is paid to the invective
and obscene vocabulary, considered in the criminal law aspect, as the most
common manifestation of the humiliating attitude towards the addressee of
the offence. Invective vocabulary (invectiva oratio, Latin): verbal aggression,
humiliating vocabulary, abusive speech. Obscene vocabulary (obscenus
/Latin/: undignified, lecherous, immoral).
