On the Sick Law and Sick Politics

Abstract:

This paper tries to develop, in a theoretical aspect with the means of the philosophy of law and politics, the idea of applying the concept of ‘disease’ to these most important areas of social relations. This concept entered our lives rather aggressively along with the global pandemic and the decree-based rule initiated by global factors. It would be interesting to answer the question of whether we can find a symptom of an overall disease of modern politics and law in this ridiculous situation. The analyzed symptoms of the serious illness of today’s law and politics lead to the conclusion that present-day society needs very serious, revolutionary transformations to restore the perspective that these important spheres of public relations serve to solve the problems and conflicts of citizens. They will lead to the collapse of the system of today’s neoliberal authoritarian order and to the return of the nation-state to the protection of the people’s interests.
