It is the task of this article to study the legal nature of deprivation of the proceeds of crime regulated by the Administrative Violations and Sanctions Act and to examine the prerequisites of its application. The analysis of similar state sanctions allows being specified key principal characteristics and factual aspects of deprivation of proceeds of crime, settled in art. 83a, para. 4 of the Administrative Violations and Sanctions Act. The article aims to provide a discussion of the main legal problems that may arise in the process of independent implementation of different measures of deprivation of the proceeds of crime.
